These Terms of Service ("Terms") govern your use of MDside, operated by MDside ("we", "us", or "our"), including this website, its checkout, and your patient account (together, the "Services"). By creating an account or placing an order you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old, located in the United States in a state we serve, and ordering for yourself. We currently serve patients located in Colorado, Florida, Illinois, New Jersey, New York, North Carolina, and Ohio.
Accounts are personal. Sign-in is by a one-time code sent to your email address, and you are responsible for activity under that address. Do not share your sign-in codes.
Prescription products require review and approval by a licensed healthcare provider before they can be fulfilled:
Approval is not guaranteed. The provider's decision is an independent clinical judgment. Do not rely on a pending order for any health need.
Content on this site is for general information only and is not medical advice, diagnosis, or treatment. Individual results vary. Only the licensed provider who reviews your request can advise you about your care.
This is not emergency care. If you have a medical emergency, call 911 or go to the nearest emergency room. Do not use the Services for urgent needs.
Approved prescriptions are filled and shipped by a licensed U.S. pharmacy that ships to your state.
Providers may prescribe compounded medications when appropriate for your needs. Compounded medications are prepared by a licensed pharmacy for an individual patient. The U.S. Food and Drug Administration does not review or approve compounded medications for safety or effectiveness. Actual product packaging may differ from images shown.
Prescriptions are issued at the provider's sole discretion, are not transferable, and may be limited in quantity or refills.
Prices, treatment plan terms, shipping options, and any fees are shown before you pay. Payment is processed by our payment processor; we never store your full card number.
When you place an order, your payment method is authorized for the first payment of the plan you chose. You are charged only when a provider approves your request. If your request is declined, the authorization is released and you are not charged for it. Authorizations that are not captured may take several business days to disappear from your statement, depending on your bank.
Treatments are sold as treatment plans. The plan's length, the number of shipments, the price of each billing cycle, and whether you pay per cycle or up front are shown before you pay and again on your order confirmation.
Standard shipping is included in your plan price. Where offered, you may choose a paid faster shipping option at checkout; the upgrade applies to that shipment only. Delivery times are estimates and depend on the pharmacy and carrier. Medications ship only to the address you verified at checkout and cannot be redirected in transit.
Refunds, when issued, go back to the original payment method.
Your account shows your orders, treatment plans, and shipments, and lets you message us about your care. Messages are part of your medical record. Do not use messaging for emergencies. We may close accounts that are inactive, used fraudulently, or in violation of these Terms.
By placing an order you agree to receive automated transactional text messages, calls, and emails about your order and care. Marketing messages are sent only if you separately opt in, and consent is not a condition of purchase. Message frequency varies, and message and data rates may apply. Reply STOP to stop texts or HELP for help. See our Privacy Policy for details.
Do not misuse the Services: no unauthorized access, scraping, interference with operation, false identities, or unlawful use. We may suspend or close accounts that violate these Terms, and we may decline to serve you where permitted by law.
The content, design, and trademarks on this site belong to us or our licensors. You may use the site for your personal, non-commercial use only.
THE WEBSITE, CHECKOUT, AND PATIENT ACCOUNT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, WITH RESPECT TO THE WEBSITE AND ITS OPERATION. NOTHING IN THESE TERMS LIMITS OR DISCLAIMS THE PROFESSIONAL DUTIES OWED TO YOU BY A LICENSED PROVIDER OR PHARMACY, OR ANY RIGHTS YOU HAVE UNDER CONSUMER PROTECTION LAW THAT CANNOT BE WAIVED.
TO THE EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM YOUR USE OF THE WEBSITE, CHECKOUT, OR PATIENT ACCOUNT (AS DISTINCT FROM THE MEDICAL CARE YOU RECEIVE) IS LIMITED TO THE GREATER OF $100 OR THE AMOUNTS YOU PAID THROUGH THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM. THIS SECTION DOES NOT LIMIT LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, PERSONAL INJURY CAUSED BY NEGLIGENCE, PROFESSIONAL NEGLIGENCE, OR ANY LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
These Terms are governed by the laws of the state in which MDside is organized, without regard to its conflict-of-law rules, except where the consumer protection law of your state applies and cannot be waived. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in that state, and you consent to their jurisdiction. Before filing a claim, contact us (Section 18) so we can try to resolve it with you.
We may update these Terms. The current version is always posted on this site with its "Last updated" date. Material changes take effect when posted and, where required, when you accept them again at your next sign-in or checkout. Continued use of the Services after changes means you accept them, where permitted by law.
